This Agreement (“Agreement”) is entered into on {sign_date}, by Abada-Capoeira DC – Brazilian Arts Center Inc., a Virginia corporation, (“Abada-Capoeira DC”) and {name}

Recitals:

WHEREAS, Abada-Capoeira DC operates a martial art program; and

WHEREAS, the Student desires to join Abada-Capoeira DC program and, in exchange, agrees to be bound by the terms of this agreement.

Now, Therefore, in consideration of the mutual covenants and undertakings of the Parties as set forth herein, each Party intending to be fully and legally bound, and for other good and valuable consideration, the receipt and sufficiency of which is acknowledged by the signatures of all parties hereto, the Parties hereby agree as follows:

The recitals set forth above are hereby incorporated herein as if set forth in full.

The Student undersigned, acknowledges and is fully aware that he/she has voluntarily applied to participate in related activities conducted and/or offered by Abada-Capoeira DC (by this reference, including its members, managers, directors, officers, employees, Masters, Mestrandos (as), professors, instructors, graduated, and/or agents of the Abada-Capoeira DC, collectively referred as “Abada-Capoeira DC Personnel”). This Instruction includes, but is not limited to, exercises, instruction, drilling, sparring, competition, techniques and methods of the Abada-Capoeira DC program which include, but are not limited to, the martial art commonly known as capoeira.

The Student acknowledges, is fully aware and understands that the Abada-Capoeira DC program is an inherently dangerous and hazardous activity and could result in serious bodily injury and/or death.

The Student voluntarily participates in the Abada-Capoeira DC program with full knowledge and understanding that the risks, dangers and hazards of participation include, but are not necessary limited to, the possibility of serious bodily injury and death.

The Student hereby assumes any and all risks of injury or death caused either directly or indirectly by the Abada-Capoeira DC program and/or the Student’s participation in the Abada-Capoeira DC program.

Additionally, the Student saves and holds Abada-Capoeira DC and the Abada-Capoeira DC Personnel harmless from any and all personal injury claims and waives any such claims if any kind or nature whatsoever which may arise in connection with the Student’s direct or indirect participation in the Abada-Capoeira DC program.

Additionally, the Student hereby agrees that the Student, his/her spouse, parents, heirs, assigns, distributes, guardians, successors-in-interest and legal representatives will not make a claim against, or file any legal action of any kind or description against the Abada-Capoeira DC including, but not limited to, any action or claim for damages, injury, emotional distress, bodily injury, death or punitive damages due to or resulting from the Student’s participation in the Abada-Capoeira DC program.

The students also grant Abada-Capoeira DC the irrevocable and unrestricted right and permission to take, copyright the same, to use, reuse, publish and republish audio recordings and video images, photographic pictures, etc. (“Material”) that Abada-Capoeira DC had taken of him/her or in which he/she may be included with others, the same in whole or in part, or composite, or distorted in character or form, without restrictions as to changes or alterations, made through medium at any location, and in any and all media now and hereafter known, and for illustration, promotion, art, editorial, advertising, trade or other purpose whatsoever. The Student hereby waive any right that he/she have to inspect or approve the finished products.
